Buying Property in Spain
We act for clients purchasing plots of land, farms, estates, villas and apartments in Spain without your having to waste time and money travelling to Spain. We shall advise, explain and ensure:
- You have a full report in English
- that title is registered in the vendor’s name free of any mortgages or charges
- that the property is purchased free of any liability a non-resident vendor may have for Spanish gains tax by deducting the statutory withholding tax and paying this over to the Spanish Revenue
- on the taxes and expenses payable in addition to the purchase price
- you on the potential liability to Spanish gains and inheritance tax in the event of sale or death
- the effect of Spanish forced heirship rules and advise on how to tailor your purchase to meet them
- completion of the purchase takes place before the Notary Public in Spain and register your title at the Land Registry
- prepare Spanish Wills which come together with your English Wills.
- for newbuilds we can require the developers to provide adequate safeguards covering the refund of advance payments in the case of their insolvency.
Disbursements
- Travel expenses for an Abogado (“Spanish Solicitor”) if the client prefers us to come along before the local Spanish Notary Public or act on his or her behalf, and
- Formalising registration of the new situation at the Local Land Registry.
The following taxes would be applicable:
- ISD (Impuesto sobre sucesiones y donaciones).
- ITPAJD (Impuesto sobre transmisiones patrimoniales y actos jurídicos documentados)
